Terms of Service

By accessing or using ArtBook ("Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We may update these Terms from time to time; continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information at registration and to keep that information up to date. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately of any unauthorized use.

Sellers must apply through Open Your Shop and be reviewed by our curation team. Verified artists agree to the originality pledge: artworks must be created by the seller (or be properly licensed editions of their own work), and any AI involvement must be clearly disclosed. Listings must include accurate title, description, dimensions, year, materials, and condition.

Artists retain full copyright of their original works. ArtBook acts solely as an intermediary venue for transactions between buyers and sellers. We do not take ownership of physical pieces at any point in the transaction lifecycle. By listing an artwork, the artist grants ArtBook a non-exclusive license to display and promote that listing within the Platform and in our marketing materials.

Bids placed on ArtBook are legally binding. When you submit a bid, you commit to purchase the item at that price if you are the winning bidder. Bids may only be retracted in narrow cases (e.g. typographical error, technical fault) and at our sole discretion. Auctions close at the published end time; we may extend an auction by a few minutes if a bid is placed in the final seconds, to ensure fair competition.

All payments are processed by Stripe. Card data never touches ArtBook servers. We charge buyers the listed price plus any shipping fees and applicable taxes. Sellers receive payouts via Stripe Connect after deducting our platform commission and any payment-processor fees. Specific commission rates are visible to verified artists in their Shop dashboard.

Shipping is handled directly by sellers. Sellers must ship within 7 days of an order being placed and provide a tracking number. Buyers may request a return within 14 days of delivery if the artwork materially differs from the listing or arrives damaged. Refunds are processed back to the original payment method once the artwork is returned in its original condition.

You agree not to: (a) list reproductions of other artists' work; (b) misrepresent AI involvement, dimensions, year, condition, or materials; (c) attempt to move payments off-platform; (d) harass, threaten, or impersonate other users; (e) use the Platform for any illegal purpose; (f) attempt to access another user's account; or (g) reverse-engineer, scrape, or interfere with the Platform's systems. Violations may result in removal of listings, account suspension, or legal action.

ArtBook will never request your password, Stripe credentials, or 2FA codes through chat, email, or any other channel. We monitor messages for known scam patterns and act on user reports promptly. If you suspect fraud, report it via the Contact page using the topic 'Report a suspicious user'. Repeated or severe violations result in permanent account termination.

If a dispute arises between a buyer and a seller, both parties should first attempt to resolve the issue through ArtBook Messages. If no resolution is reached, contact support and our team will review the conversation, payment status, and supporting evidence. Our decisions on disputes are final within the Platform; nothing herein limits any rights you may have under applicable consumer-protection law.

You may close your account at any time by contacting support@artbook.com. We may suspend or terminate your account with notice for violations of these Terms, or without notice for severe violations such as fraud, money laundering, or threats to other users. Termination does not affect outstanding obligations (payments, shipments, refunds).

The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability or that listings are free of errors. To the fullest extent permitted by law, ArtBook is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, goodwill, or data, arising out of or related to your use of the Platform.

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. You agree that any dispute not resolved through the steps in Section 10 shall be brought exclusively in the state or federal courts located in New York County, New York.
